When a marriage, civil partnership or cohabitant relationship breaks down, there are a number of issues to consider. These include what arrangements should be put in place for your children, what should happen with the home in which you lived together, whether payment of aliment is appropriate, and how the rest of your shared property should be divided.
Wherever possible, we try to encourage non-court solutions to such family problems. For example, it is often the case that division of your shared assets can be regulated by a Minute of Agreement, often referred to as a 'legal separation', leaving parties able to divorce or dissolve their civil partnership in the fullness of time, certainly without a Sheriff being asked to consider your financial issues.
However, it is not always possible to avoid matters going to Court, and our solicitors have a well established reputation in handling complex and contentious family matters for clients all around Scotland. For instance, if an accusation of domestic violence has been made, protective measures will usually be necessary and can only be sought by the raising of Court proceedings.
